ToTop is a company based in Iraq located at: Justice Tower, 10th floor, Office 15, Erbil, Kurdistan, Iraqwe have created this privacy statement in order to demonstrate our firm commitment to the privacy of the details that you provide to us when using our website.

Unless otherwise indicated all definitions in the Students and Parents Policy and the Teachers Policy shall apply to this statement. In this statement, references to “you” and “your” are references to the user of to-top.org regardless of whether you are a student or a teacher. It applies to information we collect about users of our website and among other things, this statement describes what personally identifiable information “Personal Information” we collect from you, how and when it is used, how we protect it, and who has access to it. 

1. Policy of Personal Information 

This policy explains our processing of your personal data and your rights. 

1.1 What information is collected? 

As part of the process of using the website and the services, we require you to give us certain personal information which we need to provide our services. Without this information, we may not be able to fulfill our contract with you. This information includes:

  • Account information: to enable us to create an account for you on the website. Depending on whether you register as a parent, student, or teacher, this information can include your name, email, telephone number, and date of birth.
  • Teacher application details: so we can process your application to become a tutor. These details include your educational background and qualifications, your tutoring subjects, your profile picture and video resume, your resume, the prices you charge, your availability, and your gender.
  • Communication history: to enable communication with other users of the website and with the ToTop team, we store details about your communication history including user messages, requests you have made, and your interactions with the ToTop team (including call recordings).
  • Booking history: to facilitate tutorials including information on booking requests, the status of bookings, booking subjects and levels, results of your set-up tests whilst using the lesson space, and recordings of your bookings (bookings include face-to-face and virtual classes.)
  • Identity verification information: when you apply as a teacher we ask for verification that you studied at the university you claim to. We also ask for information to demonstrate that you have the right to work in Iraq.

1.2 How is the information used?

The website asks you to provide various types of personal information to enhance the quality of the services we can provide to you and the more accurate the information you provide, the better we are able to respond to your requirements.

We use your information primarily to fulfill our contract to provide you with the services that you request, and related services. We run the following processes to fulfill our contract with you:

  • Enabling you to access the website and create an account,
  • Enabling teachers to create and promote their profile on the website,
  • Facilitating matching between customers and teachers, including personalizing your experience to show you the most relevant matches,
  • Enabling you to communicate with other users,
  • Enabling bookings between customers and tutors,
  • Providing recordings,
  • Enabling payments,
  • Providing support for customers and teachers,
  • Providing photos and videos to create trust and enable better connections between users,
  • Ensure quality of service,
  • Preventing fraud, spam, and abusive or inappropriate behavior,

1.3 Who has access to some of your personal information?

Your personal information may also be viewed by teachers (where you are a student) or by a student or teacher (where you are a teacher) for the sole purposes of enabling teachers to deliver their tutoring services directly to you and to provide you with information about their tutoring services and access to the tutoring services themselves.

If you as a student make a request for tutoring services with a teacher via the website, your personal information will be shared with the teacher to enable the teacher to deliver the tutoring services or to follow up on any inquiry. Such details may include: first name and initial of surname, the contents of your message, and the subject and level you requested.

If you as a tutor submit personal information on the website for example by creating a profile, personal information in your profile may be accessible by any user who visits the Site. The personal information shared may include: first name and initial of surname, university details, the resume you write, your profile picture and video, your grades, your tutoring subjects and price band, your tutoring record, and reviews. Releasing this personal data is necessary for you to make use of the website and the services.

1.4 How long do we keep your information? 

We will retain your personal data for different periods depending on the service you have chosen to use us for. Data will be held by us for the period necessary to meet the purposes for which we initially collected the information.

  • By default, we retain personal data for six years after you have last been active on the website. This is to allow you to continue to use your account for the duration of the average lifecycle of a ToTop user.
  • After that period has passed, or after you request us to delete your data, we will delete your personal data except where we have a specific reason which means we need to keep it for longer.
  • Records that you have shared publicly or have shared with another user, for example, reviews you leave, messages you send and bookings you make, may remain on the website after your personal information has been deleted but will no longer have to identify information which links them to you associated with them.

1.5 Deletion of your personal information

You can ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing, where you have withdrawn consent for us to process it, where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law.

When you as a teacher use our website and tutoring services, you accept these and Personal Information Policies and the Terms and Conditions

3.1 Your agreement with ToTop 

By using the website and the services, you accept these Teachers Terms in full. ToTop reserves the right to change the terms at any time. Please check this page of the website periodically. Read it carefully and ensure that you understand its effect before proceeding to use the ToTop services. If You disagree with any part of the Teachers Terms, do not use the website or the ToTop services. If you are uncertain as to your rights under these Client Terms or you want any explanation about them please contact us.

2.2 Client registration and ToTop services

2.2.1 Client registration

As a student under eighteen (18) years of age, you need to register and provide us with your name and email address and the student’s sponsor also needs to register and provide us with a name and contact email address. Sponsors shall be responsible for managing the provision of all elements of tutoring services on behalf of students including but not limited to being responsible for, purchasing ToTop credits, receiving email communications from ToTop, transferring credits into the others wallet, etc.

During Sign up, in order to provide you with maximum protection, you will be asked to input your username (which will be your email address) and you will be asked to choose a password to access your account on the website and to benefit from the services in accordance with these Client Terms. You will keep your password relevant to the website and the services confidential and not reveal it to anyone else. You are responsible for all activities that are carried out under your username and password which shall represent your ToTop login. We do not have the means to check the identities of all people using the website and will not be liable where your username and/or password are used by someone else. You agree to notify ToTop immediately by email to support@to-top.org of any unauthorized use of your account of which you become aware. You will not create additional accounts for the purpose of abusing the functionality of the website or other registered clients or for any other reason in breach of this agreement.

2.2.2 When you are creating your account, you will be required to complete your registration by telling us some basic information about you by using our simple online form (“Registration”).

Completing registration will give you access to protected areas of the website. You can proceed to select potential teachers by reviewing their personal résumés and viewing their introductory video. If applicable, you may read client ratings from others who have previously been a client of that teacher.

2.2.3 Clients can purchase tutoring services on a pay-as-you-go basis or by purchasing ToTop credits.

ToTop credits are held in the client’s ToTop wallet and can be redeemed against the purchase of tutoring services from a teacher. Provided that you have sufficient ToTop credits in your wallet, the requisite number of ToTop credits payable shall be deducted from your wallet automatically upon the booking of a lesson and the balance of ToTop credits in your wallet shall be reduced accordingly. 

2.2.4 You may request a refund for unused ToTop credits in your wallet at any time.

2.2.5 ToTop reserves the right to suspend or terminate Your ability to purchase tutoring services at any time and for any reason without liability to ToTop.

Where terminated, your ToTop login and account shall be deactivated. ToTop reserves the right to terminate after a six (6) month-long continuous period of inactivity which means that you will no longer be permitted to use the ToTop services to purchase tutoring services via the website. You will not be permitted to re-access the website and the ToTop services without ToTop’s express written permission and any terms intended to survive termination.

2.3 Clients obligations 

When you use the website and the services and when you book and accept the tutoring services, you must comply with any requirements as directed by ToTop and the teacher as amended from time to time and in accordance with these client terms. Client further and specifically agrees:

  1. to obtain and maintain all ToTop tools to use and access the Services. Any problem concerning a technical issue regarding a Client’s personal computer or internet service provider is not the responsibility of ToTop.

  2. to procure, maintain and pay for the latest available version of security software to protect against the transmission of viruses and other computer malware during Your access to and use of the Services;

  3. to provide promptly and give to the teacher all such information as they may reasonably require in connection with the provision of the Services;

  4. to cancel the booking if you are unable to attend a booking so that the teacher will get notifed;

  5. to be solely responsible for assessing the suitability of a teacher to deliver the Tutoring Services and the accuracy of their stated credentials, expertise, references.

  6. to contact a teacher via teacher mail and ToTop instant messaging facility via the website only. Other means of communication is prohibited;

  7. not to act as an agent to promote the services or opportunities of a company; and,

  8. not to publish any abusive comments about a teacher or another student on the website or any other place including defamatory or derogatory comments.

2.4 ToTop obligations 

2.4.1 ToTop agrees to:

  1. provide the ToTop Services with all due care, skill and ability and in a timely manner and in the best interests of the Client and the Teacher;

  2. devote as much time to the provision of the ToTop Services as may be necessary for their proper performance;

  3. provide promptly and give to the Client all such information as they may reasonably require in connection with the provision of the ToTop Services.

2.4.2 As an online service, ToTop may periodically be unavailable as we perform regular (and emergency) maintenance and upgrades.

Where reasonably possible, these activities shall be notified to You in advance. ToTop makes no warranty, guarantee or representation as to, and accepts no liability for, the availability or suitability of the website and/or the ToTop Services.

2.4.3 You are solely responsible for validating the interoperability and proper functioning of the MTW Tools during the free meeting and for undergoing troubleshooting where necessary.

See the FAQs provided on the website relating to “Technical” questions about the lesson space which offer access to technical guidance that may assist You. This includes information relating to the minimum system requirements.

2.5 Client Fees

Clients will only pay for the amount that will be spent with teachers. The teachers should agree that a small amount will be deducted from their gross income by ToTop for the service they are suing. 

2.6 Conduct and Fraud 

2.6.1 You may only access the website and use the services for lawful purposes.

You are solely responsible for the knowledge of and adherence to any and all laws, rules, and regulations pertaining to your use of the services

2.6.2 You agree that you will treat the teachers with respect and not use obscenities, make threats, or discuss matters other than those directly related to the subject of the lesson.

2.6.3 You agree that you will not disclose any information to a teacher that could be considered personally identifiable information including your address, telephone number, email address, password, or any other information that could be used to identify or locate you.

A violation of this agreement may lead to a suspension of your Account. It is understood that ToTop will pass your name on to your teacher and you hereby forfeit your privacy and anonymity under these Client Terms to the extent necessary to utilize the Services.

2.6.4 You agree that you will not solicit any such information from any teacher, and agree that if any teacher ever discloses such information to you; asks you for any personal information or suggests any offline meeting or conversation; You will immediately report this to us.

2.6.6 You shall not, without the prior written consent of ToTop, at any time from the date of commencement of these Client Terms to the expiry of six (6) months after termination of these Client Terms whereupon Your Account and ToTop Login are deactivated, solicit or encourage one to one tuition or other tuition services either in person or online to a person who is, or has been, a teacher introduced to you by ToTop.

2.7 Intellectual Property 

You acknowledge that all lessons that you deliver may be recorded and you agree to the storage and use of such recordings by ToTop.

2.8 Cancellations, Rescheduling, No-show

All lesson cancellations or requests to reschedule must be made directly via our website and in writing to support@to-top.org.

If you do not show up and did not cancel the meeting several times in a row and you did not notify us, you will be entitled to termination, and you will not have access to your ToTop account.

2.9 Feedback and ratings 

It is a feature of our website and the ToTop services that the client will leave client ratings.

Clients can rate the quality of the services provided by a specific teacher after every lesson held between them, 

A teacher or a client can report or raise any issues or concerns that they might have with the other at any time.

2.10 Disputes 

All disputes reported to ToTop by a client or by a teacher via the website will be investigated at ToTop’s option.

  • ToTop reserves the right to inform a teacher or a client respectively of any dispute raised against them and to provide them with a copy of any response provided by ToTop.

  • You must inform ToTop immediately and in any event, within twenty-four (24) hours, of any dispute you may have with a teacher in connection with the provision of the tutoring services rendered by a teacher or otherwise.

  • You agree to cooperate fully with ToTop in resolving any dispute with a teacher.

  • ToTop reserves the right to suspend your account with immediate effect while an investigation is conducted.

2.11 Termination

ToTop reserves the right to terminate this agreement with you immediately if you commit a breach of any of these client terms, or if:

  1. any information provided by you is found to be untrue, inaccurate, out-of-date, or incomplete;

  2. You act in any way that has brought or could bring, ToTop into disrepute; or,

  3. You do not show up at a lesson without having canceled it or you repeatedly cancel lessons.

2.12 Warranties and indemnities

As a client, you hereby warrant, represent, and undertake to ToTop and teachers that:

  1. Student is at least eighteen (18) years of age and if not, both student and sponsor will each register on the website;
  2. You are personally responsible for the information posted by you on the website and submitted throughout sign pp and registration which you shall ensure is accurate, true, and up-to-date:
  3. Whilst this contract is in force you will only ever contact a teacher via the website;
  4. You will protect your unique password;
  5. You accept full responsibility for any disputes raised as a result of issues connected to the performance or non-performance of your ToTop tools affecting your proper access to the tutoring services;

 


3. Teachers Policy 

When you as a teacher use our website and tutoring services, you accept these and Personal Information Policies and the Terms and Conditions

3.1 Your agreement with ToTop 

By using the website and the services, you accept these Teachers Terms in full. ToTop reserves the right to change the terms at any time. Please check this page of the website periodically. Read it carefully and ensure that you understand its effect before proceeding to use the ToTop services. If You disagree with any part of the Teachers Terms, do not use the website or the ToTop services.

3.2 Becoming a tutor

3.2.1 To be entitled to become a Tutor via the website, you agree that these Teachers Terms before using services of the website.

You will first register on the website and complete a short online application form. If your initial application is successful, you may be invited to participate in a telephone interview or an interview session in the virtual lesson space. If successful, you will complete a further registration by providing a short resume, your photo ID, details of your current account, and a brief self-promotional video.

3.2.1 In order to provide you with maximum protection, during registration, you will be asked to input your username (which will be your email address) and to choose a password to access your account on the website in accordance with these Teachers Terms.

You are responsible for all activities that are carried out under your username and password which shall represent your ToTop login. You agree to notify ToTop immediately by email at support@to-top.org or contact us at 0750 430 80 38 of any unauthorized use of your account of which you become aware.

3.2.3 Once a teacher has been selected to provide the tutoring services via the website and has a secure ToTop login, the teacher can benefit from full use of the website and the ToTop services.

The website enables teachers to independently build up a professional teacher profile and to promote their tutoring services.

3.2.4 ToTop reserves the right to suspend or terminate your ability to render tutoring services at any time and for any reason without liability to ToTop.

Where terminated, your ToTop login and account shall be deactivated. ToTop reserves the right to terminate after a one (1) month-long continuous period of inactivity which means that you will no longer be permitted to deliver tutoring services via the website. You will not be permitted to re-access the website and the ToTop services without ToTop’s express written permission.

3.3 Teachers obligations

When you make use of the website and the ToTop services and when you provide tutoring services to your students, you must comply with any operational requirements as directed by ToTop and as amended from time to time and in accordance with these Teachers Terms. You further and specifically agree to:

  1. assume all responsibility for your role as a teacher and for the provision of tutoring services to the client which includes the preparation and content of lessons;
  2. accept booking requests made by clients via the website which you will be notified about via your teacher mail within a reasonable time frame;
  3. accept full responsibility for any client disputes raised as a result of issues connected to the performance of your ToTop tools affecting the performance of your tutoring services provide the tutoring services with all due care, skill and ability and in a timely manner and in the best interests of the client;
  4. accept that any problem concerning a technical issue regarding a teacher’s personal computer or internet service provider is not the responsibility of ToTop.
  5. act at all times in accordance with the highest professional standards;
  6. only accept instructions within your sphere of abilities and competency;
  7. notify ToTop immediately should you become incapacitated in any way and unable to provide the tutoring services. 
  8. ensure that any information provided by you to ToTop remains true, accurate, and up-to-date.

3.4 ToTop obligations 

3.4.1 ToTop agrees to:

  1. provide the ToTop services with all due care, skill and ability and in a timely manner and in the best interests of the client and the teacher;
  2. devote as much time to the provision of the ToTop services as may be necessary for their proper performance;
  3. provide promptly and give to the teacher all such information as they may reasonably require in connection with the provision of the ToTop services.

3.4.2 As an online service, ToTop may periodically be unavailable as we perform regular (and emergency) maintenance and upgrades.

Where reasonably possible, these activities shall be notified to you in advance. ToTop makes no warranty, guarantee or representation as to, and accepts no liability for, the availability or suitability of the website and/or the ToTop services.

3.4.3 You are solely responsible for validating the interoperability and proper functioning of the ToTop tools during the free meeting and for undergoing troubleshooting where necessary.

ToTop shall not be responsible nor liable to you as a result including for any act or omission on your part relating to your inability to access the services in whole or in part including but not limited to:

  1. resultant feedback (echos), audio break-ups, video or sound delays;
  2. Your failure to use and configure the prescribed headset and microphone;
  3. Your failure to at least meet the minimum system requirements.

3.5 Client fees, teacher fees, and ToTop payments

  • Teachers authorize ToTop to charge and collect on behalf of teachers.

  • All costs relating to lessons and ToTop payments are reviewable by tutors and ToTop and any revised fees and charges shall take effect immediately upon posting on the website and will be applicable to all bookings made after such posting.

  • ToTop shall pay to teachers an amount equal to the teachers' achievement collected by ToTop, less any charges for ToTop services made in connection with this agreement.

  • You agree to pay 10% of your gross income to ToTop for the services that you use on the website. 

3.6 Cancellations, rescheduling, no-show

  •  Arrangements between clients and teachers may be canceled by either party at any time in advance of the lesson taking place.

  •  In the event of cancellation of the tutoring services by the client, you shall not be paid for that lesson.

  • No-show by the teacher at a lesson without having canceled it as well as repeated cancellations of lessons by teachers may result in the termination of this agreement between teacher and ToTop.

  • All cancellations must be made in writing in advance, directly via the website.

  • Should a student fail to attend a lesson without giving written advance notice, you shall not be paid for that lesson.

3.7 Client ratings, feedback, and other activities

  1.  It is a feature of the website and the ToTop services that the client will leave Client Ratings.

  2. ToTop is entitled to carry out an investigation upon receipt of negative Client Ratings (rating of 1, 2 or 3 out of 5) or where a teacher or a client reports or raises any feedback, issues, or concerns that they might have with the other at any time.

3.8 Termination

ToTop reserves the right to terminate this agreement with you immediately without compensation nor written notice if you commit a breach of any of these Teachers Terms, or if:

  1. any information provided by you is found to be untrue, inaccurate, out-of-date, or incomplete;
  2. Your performance of the tutoring services is deemed by ToTop in its sole discretion to be unsatisfactory;
  3. You act in any way that has brought, or could bring, ToTop into disrepute;
  4. You are convicted of a criminal offense or are the subject of any investigation, which may in ToTop’s opinion affect your role as a teacher;
  5. You are unable to carry out your duties for any reason whatsoever; or,
  6. You do not show up at a lesson without having canceled it or you repeatedly cancel lessons.

In the event of any such termination, you will be entitled to receive payment from your client for all tutoring services already successfully delivered and which are not the subject of a dispute as at the date of termination but ToTop shall not be liable for any losses incurred by you after the date of termination.

3.9 Warranties and indemnities

 As a teacher, you hereby warrant, represent, and undertake to ToTop that:

  1. You are at least eighteen (18) years of age and you have the necessary qualification or experience to provide the tutoring services in the subject(s) you offer in your profile on the website;
  2. You are personally responsible for the information posted by you on the website;
  3. You will comply with all the teachers' obligations;
  4. You will only ever contact a client via our website;

3.10 Disputes

3.10.1 Negative feedback (rating of 1, 2, or 3 out of 5) reported to ToTop by clients via the website may be investigated.

ToTop reserves the right to inform a teacher or a client respectively of any dispute raised against them and to provide them with a copy of any response provided by ToTop.

3.10.2 You agree to cooperate fully with ToTop in resolving any dispute with a ToTop client.

3.10.3 ToTop reserves the right to suspend your account with immediate effect while an investigation is conducted.

Your account may be reactivated once an investigation has been completed.

3.11 Intellectual property 

You acknowledge that all lessons that you deliver may be recorded and you agree to the storage and use of such recordings by ToTop.
